  7. Demonii, the largest standalone BitTorrent tracker on the Internet, has been forced to ban more than 10,000 'copyright-infringing' torrent hashes. The blocking measures follow pressure from a music industry lawfirm applied to both the tracker and its hosting company. The tracker disagrees with the "bullying" tactics being employed. At any given point in time, millions of people are sharing files via BitTorrent. The most used trackers process millions of requests per minute, serving between 15 and 30 million people at once. Demonii is one of these top BitTorrent trackers. The standalone tracker offers no torrents but merely coordinates communication between people who share files via sites such as The Pirate Bay. Technically speaking a tracker is similar to a DNS provider, it’s a ‘phone book’ which points people to content without knowing what it is. However, according to German lawfirm Rasch, trackers have a responsibility to block infringing hashes if they are asked to. Earlier this year the lawfirm took action against the hosting companies of several standalone trackers after they failed to block “infringing†hashes. The operator of Demonii, currently the most used BitTorrent tracker, informed us that they were contacted too. “First we received an email from Rasch asking us to remove about five torrent hashes for one music artist. Since the firm is merely an agent and not the actual copyright owner, I asked for proof that he is the lawful agent,†Demonii’s operator explains. The lawfirm provided the requested paperwork and to avoid problems with the hosting company, Demonii blocked the five hashes. This was the first time that Demonii had ever blocked content, which is nothing more than filtering a piece of HEX string. However, it soon became clear that Rasch was just getting started. In the weeks that followed the company filed complaints against 10,000 allegedly infringing hashes which pointed to content from various copyright holders. Again, Demonii requested proof that the firms was acting as a lawful agent, but this time Rasch declined. Instead, Rasch lawyer Mirko Brüß told the operator that anyone can report copyright infringements. “Anybody can notify you of an infringement, even if they are in no way affiliated with the rights owner. Please understand that we will not go above and beyond what is provided by the law in order to satisfy your personal requests,†Brüß wrote in an email. “It is your decision to act upon the information sent to you. But with regards to blocking content wrongfully, the content owners could approach us with claims for damages for sending a false notice to you,†he added. The Demonii operator disagrees with this assessment and calls out the claim as incorrect. “If what he is saying is right, in theory, I can go send an email to his hosting provider to remove their site? After all I am not the owner and no way legally affiliated, but I can still claim the take down?! — No.. I can’t, and neither should he,†he tells TF. However, with pressure shifting to the tracker’s hosting service (which had given the tracker 24 hours to comply), Demonii was eventually forced to block all reported hashes. Describing the lawfirm’s tactics as “bullyingâ€, the operator decided to move away from its hosting company to one that may be more resistant to this type of pressure. “We have moved to a different hosting provider, one which we hope will take the matter more seriously and not just bend over backwards for any outrageous claim and takedown request where ownership can not be proven,†Demonii’s operator says. The previous hash blocks have also been lifted, so Demonii is starting over fresh and uncensored again. The move hasn’t stopped the lawfirm from sending more blocking requests, but for the time being the tracker is opting to ignore these. The tracker stresses that it respects copyright law.   9. BBC Worldwide has sent tens of thousands of takedown requests to Google this week, but not all reported links are as bad as they claim. In fact, the company is targeting the IMDb pages of several of its own shows, including Top Gear and The Game, as well as one of Dailymotion's homepages. In an effort to make piracy less visible, copyright holders send dozens of millions of takedown notices to Google every month. Unfortunately not all of these requests are as accurate as they should be. Due to the high number of often automated notices and the fact that copyright holders don’t check the validity of all requests, there are many questionable takedowns. This week BBC Worldwide reported a record number of infringing links to Google, targeting more than 25,000 webpages. We decided to go through the links and it wasn’t hard to find several URLs that are clearly not infringing. For example, one of the notices targets the IMDb pages of Top Gear, The Game and Top Fails. The Internet Movie Database is one of the prime sources for movie and TV fans to get information and doesn’t host or link to infringing content, so taking these pages offline only hurts the BBC. Perhaps even more worrying is that the same notice also lists the British home of the video site Dailymotion as “infringing.†While this page may have linked to unauthorized material in the past, it’s certainly doesn’t warrant the removal of the entire homepage. Unfortunately this notice is not an isolated incident. In recent years we’ve highlighted countless examples of takedown requests that censor legitimate content, often hurting traffic for the affected sites. The good news is that Google appears to have white-listed several domains, including the IMDb and Dailymotion. This means that while the links reported by the BBC were not removed, less prominent sites may not be so lucky. As mentioned previously the DMCA notice surge is a growing problem, with Google now removing more than a million links each day on average.   11. A regional court in Hamburg has ordered a hosting company to identify the operators of three iconic BitTorrent trackers that together coordinated dozens of millions of transfers per day. The order is the result of a complaint from German music group BVMI, which says it's behind the shutdown of the trackers shut down earlier this year. OpenBitTorrent, PublicBT and Istole.it have long been the three largest BitTorrent trackers on the Internet, coordinating the downloads of 30 million people at any given point in time. This means that these non-commercial services, powered by the open source Opentracker software, handled a staggering three billion connections per day – each. We say handled, because the trackers have been offline since mid-January. The trio mysteriously disappeared, but the German music industry group BVMI now takes credit for the shutdowns. According to BVMI’s lawfirm Rasch, the hosting company took the tracker offline after they were ordered identify the operators. However, the host initially refused to disclose the personal details. In an injunction released this week a Hamburg court ordered that the hosting company now has to hand over the personal details of the tracker operators. The ruling follows a complaint from BVMI and is the first against so-called standalone BitTorrent trackers. These trackers do not host or process any infringing material themselves and are a content neutral part of the BitTorrent ecosystem. According to BVMI CEO Florian Drücke the music industry has recently expanded its focus beyond traditional torrent sites such as The Pirate Bay, to include these standalone trackers. “Without the Tracker, it will be much more difficult for those who offer and seek illegal content to make the first connection,†Drücke says. The downside, however, is that legal torrents also use these trackers to coordinate connections. According to Christian Solmecke, a German IT lawyer who has experience with file-sharing cases, the verdict comes a a surprise. “The court ruling amazes me. Apparently the court assumes that BitTorrent trackers are by definition something illegal. This is not the case,†he says. The lawyer doesn’t deny that the trackers play a role in both legal and illegal transfers, but they are content neutral and merely passing on metadata, similar to a DNS provider. “By the same argument these BitTorrent trackers are switched off you might ultimately forbid an ISP to continue to provide Internet access to end users, if copyright violations are committed,†Solmecke adds.   15. Coppersurfer, one of the largest BitTorrent trackers on the Internet, has been taken offline after it refused to block 'infringing' hashes. Hosting provider LeaseWeb pulled the plug on the site after a tip-off from Dutch anti-piracy group BREIN, who also demanded that the site operator should step out of anonymity. In recent years Coppersurfer.tk has quickly become one of the most used BitTorrent trackers. Running on the beerware-licensed Opentracker software, the standalone tracker offers a non-commercial service which doesn’t host or link to torrent files themselves. The free service coordinates the downloads of 10 million people at any given point in time, processing roughly billions of connections per month. However, since last weekend Coppersurfer.tk has been offline. Responding to a complaint from Dutch anti-piracy group BREIN, hosting provider LeaseWeb suddenly pulled the plug. According to a LeaseWeb rep “torrents are illegal†and the company had no other option than to shut down the tracker. This came as quite a surprise to the operator, since his service doesn’t link to or host torrent files. In fact, Coppersurfer doesn’t know what titles are tracked or where all the corresponding torrents are stored. Hoping to resolve the matter the tracker operator reached out to BREIN, pointing out that he provided a content neutral service. However, the Hollywood-funded anti-piracy group disagreed. One of the problems for BREIN is that The Pirate Bay uses Coppersurfer as a default tracker. This means that all torrents shared through the site are automatically tracked by the service. “Your claim that a tracker can be compared to a neutral internet service provider is not correct. The Coppersurfer tracker is far from neutral. You are aware that your tracker is used for torrents of illegal websites like ThePiratebay,†BREIN’s Pieter Haringsma replied. “There is no question about the fact that ThePirateBay is an illegal website, which is being blocked in numerous countries and, whose founders have been sentenced to jail. You know that your tracker is added automatically to all the torrents that are uploaded to that website,†he added. Interestingly, BREIN is willing to make a deal with the tracker owner if he agrees to blocklist infringing hashes. In addition, BREIN demands that the owner identifies himself claiming that all commercial services are required to so under the European e-commerce directive. “That is why you have the obligation to check [The Pirate Bay] and blacklist all illegal titles of that site, because you know that your tracker is added automatically to all the torrents that are uploaded to that website,†Haringsma wrote. “Once you have stepped out of anonymity and have implemented measures to avoid illegal use of your tracker by blacklisting illegal torrents from ThePiratebay, BREIN is prepared to discuss the terms of a proper [takedown] procedure that Coppersurfer should put in place, including e.g. enforceable penalties,†he added. The Coppersurfer operator is surprised by the broad demands and has chosen not to comply. If a standalone tracker should ban hashes, should browsers and torrent clients do the same? He also fails to see how a non-profit service that doesn’t even require a website, can be seen as online commerce. While LeaseWeb is no longer an option, the tracker operator hopes to put the service back online at another hosting company. Another option would be to donate it to an organization that’s dedicated to protecting free speech digital rights. “My plans now are to seek a new home. A new report published by the United States Trade Representative has listed the world's largest BitTorrent sites and cyberlockers as some of the most problematic copyright infringers in the world. Popcorn Time and its derivatives are mentioned too, with the former's creation blamed on YIFY/YTS. Domain name registrars are also placed under the spotlight. In its latest “Out-of-Cycle Review of Notorious Markets†report the United States Trade Representative (USTR) lists some of the world’s largest file-sharing sites as venues for prolific copyright infringement. “Commercial scale trademark counterfeiting and copyright piracy cause significant financial losses for rights holders and legitimate businesses, undermine critical U.S. comparative advantages in innovation and creativity to the detriment of American workers, and can pose significant risks to consumer health and safety,†the report begins. “The Notorious Markets List (“Listâ€) highlights select online and physical marketplaces that reportedly engage in and facilitate substantial copyright piracy and trademark counterfeiting.†Torrent Sites It’s no surprise that The Pirate Bay is on the USTR list again this year but its first mention is framed as a success. The December 2014 raid against the famous site is quite properly noted but then subsequent references paint a confusing picture. While the USTR correctly notes that the site eventually resumed operations at ThePirateBay.se, it also claims that the site first came back online at ThePirateBay.si “as well as under several other domain namesâ€. This account runs counter to the actual sequence of events which were regularly documented online. Although not mentioned specifically by name, numerous PirateBay clones also make an appearance, notably the version created by the IsoHunt.to team. KickassTorrents is also proving to be a thorn in the side of the USTR. Now reporting that the site is based in Canada, the U.S. government notes that the site reaped the rewards of the Pirate Bay takedown in December by scooping up additional traffic. It notes that the site has had domain name difficulties recently (praising the action by the .SO registry) but concedes that the site remains fully operational. Meta-search engine Torrentz.eu makes another appearance on the list this year but with an added twist. The USTR is now referring to the site as being part of a group called ‘Movshare Group/Private Layer’ which includes various Torrentz domains plus Putlocker.is, Nowvideo, Movshare, BitSnoop and Novamov, among others. “This group of affiliated and extremely popular sites, with ties to Switzerland, Netherlands, Panama, Canada, and other countries, reportedly uses multiple technologies to make available countless unauthorized copies of movies, games, music, audiobooks, software, and sporting event broadcasts,†the USTR writes. YTS.re or YIFY as it’s still known, receives particular focus in the U.S. government report. Noting that the site has millions of visitors every month and is continuing to grow, the report makes a curious allegation – that YTS is responsible for creating Popcorn Time. “Yts.re’s operators also created a desktop torrent streaming application called ‘Popcorn Time,’ similar to [spanish-focused version] ‘Cuevana Storm’,†the report reads. An interesting situation has also developed around Bulgarian torrent sites Zamunda and Arena.bg. Both sites have been present on the USTR’s list for many years and in practical terms nothing has changed in respect of the way the sites offer copyrighted material. However, the U.S. government now says that both will now be removed from the list. “[in] recognition of Bulgarian law enforcement efforts and recent reports that the operators of these sites agreed with rights holders to remove links to unauthorized movies upon notification, the sites [have been removed],†the report reads. Predictably the massively popular Russia-based RuTracker remains a “notorious site†this time around but the problems facing war-torn Ukraine haven’t given that country a free pass. The USTR remains concerned over the country’s approach to protecting copyright so torrent site ExtraTorrent.cc remains on the list alongside hosting site EX.ua. A curious addition to the list is the Spain-focused EliteTorrent. Criticized for removing content following rightsholder complaints only to replace it at a later date, the site no longer exists having shut itself down in January 2015. Cyberlockers With millions of visitors every day, file-hosting site 4shared heads the USTR list. The government notes that the site works with rightsholders by implementing a scanning system to remove unauthorized material but apparently that’s not enough. Complaints from the music industry means that the site remains on the list this time around. Uploaded.net, another regular feature of the USTR report, makes another appearance this time around. While claiming the site has alleged links to Switzerland and Netherlands, the U.S. government plucks figures directly from the recent and controversial NetNames cyberlocker report by claiming the site generates $6 million per year in revenues. With Google being asked to remove close to 10 million links from ZippyShare.com, it’s little surprise that the file-hosting site is present on this year’s list. “The site offers features that make piracy more ‘infringer friendly,’ including through accelerated downloading. Its revenues reportedly come from paid advertising, which targets the millions of users who download files from the site,†the report reads. But despite being one of the largest sites of its type, Russia’s Rapidgator gets only a short mention, possibly due to the USTR’s belief that its popularity is declining. Social network VK or vKontakte is given much more focus, however. The USTR cautiously notes the site’s efforts to reduce infringement but concludes that much more needs to be done. On the linking front Baixeturbo.org gets a notable mention.The site has been in operation for almost seven years and is reportedly popular with Brazilians. However, it’s hosted in the UK so should in theory be an easy site for the Police Intellectual Property Crime Unit to disrupt. Nevertheless, it remains online and features prominently in the USTR’s list. Domain registrars The USTR Notorious Markets report usually focused on sites and services involved in online copyright infringement, but this time around the government appears to be widening the net. For the first time legitimate companies that simply register domain names are being put under the spotlight. “This year, USTR is highlighting the issue of certain domain name registrars. Registrars are the commercial entities or organizations that manage the registration of Internet domain names, and some of them reportedly are playing a role in supporting counterfeiting and piracy online,†the report reads. “Some registrars..[..]…reportedly disobey court orders and other communications, including from government enforcement authorities. Some registrars apparently even advertise to the online community that they will not take action against illicit activity, presumably to incentivize registrations by owners and operators of illicit sites.†The USTR singles out Canada-based Tucows as “an example of a registrar that fails to take action when notified of its clients’ infringing activity. Consistent with the discussion above, USTR encourages the operators of Tucows to work with relevant stakeholders to address complaints,†the USTR writes. Successes In common with previous years the report begins with a short summary of successes. Spanish site Seriesyonkis.com and Blu-ray ripping software vendor Aiseesoft were commended for their positive actions and with some reservations noted, Chinese site Xunlei was removed from the latest list. Action taken against the German-based linking site Boerse.bz was also deemed worthy of a mention but its resurrection as Boerse.to was relegated to a fine-print footnote. Putlocker.com, a site reportedly targeted by law enforcement in 2012 and 2013 (later rebranding to FireDrive in 2014) has also been removed from the list. The USTR notes that the site may not have completely mended its ways but since traffic has dropped dramatically the site has lost its “notorious†status. Conclusion While there are no real surprises in the report, the addition of domain registrars is a notable development.
