  7. Cox Communications, one of the largest telecoms companies in the U.S., has been ordered to expose the identities of 250 of its subscribers whose accounts were frequently used to pirate music. The names, addresses and other personal details were requested in an ongoing lawsuit where the ISP is accused of failing to disconnect repeat copyright infringers. Last year BMG Rights Management and Round Hill Music sued Cox Communications, arguing that the ISP fails to terminate the accounts of repeat infringers. The companies, which control the publishing rights to songs by Katy Perry, The Beatles and David Bowie among others, claim that Cox has given up its DMCA safe harbor protections due to this inaction. The case revolves around the “repeat infringer†clause of the DMCA, which prescribes that Internet providers must terminate the accounts of persistent pirates. As part of the discovery process the music outfits requested details on the accounts which they caught downloading their content. In total there are 150,000 alleged pirates, but as a compromise BMG and Round Hill limited their initial request to 500 IP-addresses. Cox refused to hand over the requested information arguing that the Cable Privacy Act prevents the company from disclosing this information. The matter was discussed during a court hearing late last week. After a brief deliberation Judge John Anderson ruled that the ISP must hand over the personal details of 250 subscribers. “Defendants shall produce customer information associated with the Top 250 IP Addresses recorded to have infringed in the six months prior to filing the Complaint,†Judge Anderson writes. “This production shall include the information as requested in Interrogatory No.13, specifically: name, address, account number, the bandwidth speed associated with each account, and associated IP address of each customer.†The order The music companies also asked for the account information of the top 250 IP-addresses connected to the piracy of their files after the complaint was filed, but this request was denied. Similarly, if the copyright holders want information on any of the 149,500 other Cox customers they need a separate order. The music companies previously informed the court that the personal details are crucial to proof their direct infringement claims, but it’s unclear how they plan to use the data. While none of the Cox customers are facing any direct claims as of yet, it’s not unthinkable that some may be named in the suit to increase pressure on the ISP.   9. BMG Rights Management and Round Hill Music want Cox to reveal the identities of hundreds of subscribers whose accounts were frequently used to pirate music. The request is part of an ongoing lawsuit where the ISP is accused of failing to disconnect repeat copyright infringers. In the United States most large Internet providers forward DMCA notices to subscribers who’re accused of downloading copyrighted material. Cox Communications is one of the ISPs that does this. In addition, the ISP also implemented a strict set of rules of its own accord to ensure that its customers understand the severity of the allegations. According to some copyright holders, however, Cox’s efforts are falling short. Last year BMG Rights Management and Round Hill Music sued the ISP because it fails to terminate the accounts of repeat infringers. The companies, which control the publishing rights to songs by Katy Perry, The Beatles and David Bowie among others, claimed that Cox has given up its DMCA safe harbor protections due to this inaction. The case revolves around the “repeat infringer†clause of the DMCA, which prescribes that Internet providers must terminate the accounts of persistent pirates. Both parties are currently conducting discovery. In order to make their case the copyright holders have sent a long list of demands to Cox, but court records show the ISP is reserved in the information it’s willing to hand over. The company refused, for example, to reveal the identities of roughly 150,000 subscribers who allegedly downloaded infringing works from BMG and Round Hill Music. According to the ISP, the Cable Privacy Act prevents the company from disclosing this information. The music groups, however, aren’t taking no for an answer and are now asking the court to compel Cox to hand over their personal details. According to them, this information is crucial to proof the direct infringement claims. The copyright holders are willing to accept a more limited number of accounts to begin with. In a motion to compel, they ask for the personal details of 500 account holders whose accounts were repeatedly used to share pirated material. “In an effort to narrow the dispute, Copyright Holders only request the identity of and contact information associated with 500 of what appear to be the most egregious infringers,†they write. “Specifically, Copyright Holders seek the identity of subscribers associated with 250 IP addresses that have infringed the copyrights at issue since the complaint was filed in this case, and the identity of subscribers associated with 250 IP addresses that have infringed in the six months prior to the Complaint being filed,†the companies add. While the current request is limited to 500 IP-addresses, the music groups reserve the right to request more at a later stage and ask the court to grant permission to do so. “Copyright Holders also request that the Court issue an open Order requiring Cox to produce the contact information for additional direct infringers of the copyrights at issue in this case, if the need arises,†they write. There is a hearing scheduled for later this week when the copyright holders will further detail their request, if needed.   12. After more than ten years, TS-Tracker, one of the oldest and most sought-after German trackers, was shut down by its staff yesterday. At the beginning of the year, they had to wipe their whole database under some shady circumstances and came back with a three-year-old one, and now it seems like they're gone for good, at least according to several staff members. TS is just the most recent of several large German private trackers (myT, HDS, quorks) that were voluntarily taken offline by their staff in the last few months. Coincidence? Well, maybe.

  19. The results of a new poll published today in Iceland indicates that the Pirate Party has just become the country's most popular political party. According to the results, almost a quarter of all citizens would vote Pirate today. Speaking with TF, movement founder Rick Falkvinge describes the result as an "extraordinary accomplishment." On January 1, 2006, Rick Falkvinge founded the Swedish and first Pirate Party. The party has survived more than nine turbulent years while provoking heated discussion on copyright reform, privacy and freedom of speech. The party is currently enjoying its second term in the European Parliament and in January 2014 Julia Reda MEP released her draft report for the overhaul of EU copyright. As pointed out by Falkvinge himself, that fact is worthy of a double take. “A Pirate Party representative is writing the European Union’s official evaluation of the copyright monopoly, and listing a set of necessary changes,†he wrote in a TF column. And today brings yet more news which prompts a second look at a surprising headline. According to a poll carried out in Iceland over the past week, the Pirate Party is now the country’s most popular political party. For a party founded locally less than two and a half years ago, that’s an astounding achievement. Run between the 13th and 18th of March by MMR, a company experienced in measuring support for local political parties, the survey places the Pirates ahead of even the most established of political movements. According to Visir, total public support for the Pirate Party is currently riding at 23.9%, that’s up from the 12.8% reported in the last MMR survey. The Pirates have snatched the lead from the Independence Party, who led during the last poll with 25.5% but have now dropped to 23.4%. While that is a slim lead of just 0.5%, it is a lead nonetheless, and the gap between the Pirates and other parties is even more pronounced. The Social Democratic Alliance polled at 15.5% and the Progressive Party now sits at just 11.0%, marginally ahead of the Green Party with 10.8% of the support. Today’s results are an improvement over those reported in a separate survey published last week which put the Pirates in a marginal second place. That prompted cautious excitement from Pirate MP Helgi Hrafn Gunnarsson. “I’m happy to see such a reception, but you also need to keep this in mind. Firstly, it’s not self-evident that this will be the result of the elections and not self-evident that this will go on. It’s important not to become arrogant because of this,†he said. The 55-year-old, who TorrentFreak believes it has identified, was arrested at his home in Leicestershire this morning. World Wrestling Entertainment (WWE) and Ultimate Fighting Championship (UFC) events are without doubt the most popular combat-based content available today. These enterprises are big business. WWE had revenues in excess of half a billion dollars in 2014 and while UFC parent Zuffa is rather more tight-lipped about its financial position, the company is believed to be worth several billion dollars. Both companies’ revenues rely heavily on TV-focused content. In 2013, UFC-parent company Zuffa’s revenues were split roughly 58% for PPV events and ticket sales with the remaining 42% derived from TV, sponsorships and various distribution agreements. Predictably the company has a track record of reacting furiously to its content being uploaded to the Internet and has active programs to remove links and prosecute individuals, mainly in the United States. Today police in the UK have been doing the organization’s work for them. According to police the man is “believed to be one of the internet’s biggest offenders†when it comes to uploading wrestling and mixed martial arts content to both peer-to-peer and user-generated content sites. The man’s home was searched and several computers were seized. There are fewer still who are relatively easy to identify and are located in the UK. We gave PIPCU a name and asked if that person had been arrested this morning. “We do not release the name or identity of suspects at arrest stage. This information is only released once an individual has been charged,†a PIPCU spokesperson said. In any event, PIPCU are throwing some big numbers around. The unit claims that the individual is responsible for uploading more than 3.2 terabytes of data, which is the equivalent of more than 3,000 videos. Of course, that’s just his uploading. When it comes to total videos distributed things get much, much worse. PIPCU estimates that the files uploaded generated in excess of two million downloads at a cost to the industry of several million pounds. “Today’s operation serves as a clear warning to anyone thinking of uploading copyrighted material to pirate sites.   22. After The Pirate Bay switched to CloudFlare's SSL service it is no longer being blocked by most UK Internet providers. Subscribers of BT, EE, Virgin and TalkTalk can reach the site without problems via the default https address. The "bug" also affects secure versions of other blocked sites, but not all. Following a series of blocking orders issued by the High Court, several UK ISPs are required to restrict access to many of the world’s largest torrent sites and streaming portals. The most prominent target of these blocks is without doubt The Pirate Bay. As one of the most visited sites on the Internet it has been a thorn in the side of the entertainment industries for years. The Pirate Bay was one of the first sites on the UK blocklist and access has been barred since 2012. Or rather should have been barred. For a few weeks most UK Internet subscribers have been able to access TPB just fine. Ever since the site switched to CloudFlare and made the securehttps://thepiratebay.se version default, it has become widely accessible again. TorrentFreak did a quick round among subscribers of various ISPs and found that The Pirate Bay is no longer blocked by Virgin Media, TalkTalk, BT and EE. At the time of writing only Sky appears to block the site consistently. As a result, The Pirate Bay’s direct UK traffic is steadily increasing. The Pirate Bay is not the only site that’s widely accessible again. The same applies to the https versions of Torrentz.eu, Rarbg.com, Isohunt.to and various other ‘blocked’ sites. For some sites, including Kickass.to and Extratorrent, the results vary per ISP. The operator of the Pirate Bay proxy ilikerainbows.co, which had its own domain name added to the blocklist last week, believes that the unblocking relates to the use of https strict. “I believe it’s because of how CloudFlare works, Simply put when you enable HTTPS Strict on CloudFlare they remove the HTTP Header from the request during HTTPS Connections, thus when they try to inspect the header to a list of ‘banned’ websites it won’t register,†Rainbows’ operator tells TF. “So any site that uses CloudFlare, has a properly configured and signed SSL Certificate and enables HTTPS-Strict under CloudFlare should be able to evade the ban that’s imposed by Virgin and perhaps other providers,†he adds. What further complicates the matter is the fact that it’s harder to block The Pirate Bay by its IP-address, as the true location is hidden by CloudFlare’s network of addresses now. While it may be harder to block sites, it’s not impossible. Sky appears to have no trouble keeping sites blocked, although that probably requires some rather advanced and invasive monitoring tools. TF asked several ISPs for a comment on the issue and Virgin Media informed us that they still comply with the court order. “Virgin Media is required to block certain sites by the UK High Court. As a responsible ISP, we comply with court orders addressed to us,†a spokesperson informed TF this morning. Virgin’s comment suggests that the https version of TPB is not covered by the order at all, and that it was previously blocked by IP-address. However, Virgin couldn’t comment on this suggestion.   25. A site to rival the beauty of any pirate movie service on the planet has been shutdown almost before anyone had even heard of it. Named after the infamous Popcorn Time, NachoTime flourished for about a week, with glorious presentation, instant in-browser streaming plus mobile device support. Dutch anti-piracy group BREIN has confessed to the killing. While sites like The Pirate Bay are stuck in a presentational time-warp, in recent times other file-sharing related domains have been revamping their appearances. KickassTorrents is probably one of the best looking public torrent sites but there are plenty of private trackers whose presentations are something to behold. Streaming sites have also made big strides in their graphical layouts, something which has spooked entertainment industry outfits such as the MPAA. That being said, one of the biggest problems for them at the moment is Popcorn Time. Its Netflix-style interface not only looks good but behind the scenes it works almost flawlessly. Add to the mix complete simplicity of use and the software is definitely a force to be reckoned with. However, Popcorn Time – in whatever format chosen by the user – needs to be installed on a PC, cellphone, tablet or other device in order to work. A small obstacle for many users perhaps, but for the real novice that still has the potential to cause problems – unless people have nachos as well as popcorn, that is. Sometime last week a brand new service hit the Internet. Titled NachoTime, the best way of explaining the product is PopcornTime in a browser. It looked absolutely beautiful, with full color graphics for all the content it presented – mainly mainstream movies of course. Every single one played almost instantly in a YouTube-style interface with no noticeable buffering and it even worked flawlessly on mobile devices with no extra software required. In addition to instant streaming, NachoTime provided links to torrents for the same content in various qualities supported by the appropriate subtitles if needed. No other public site has ever looked this good. However, all of this is now relegated to history as Dutch anti-piracy group BREIN acted against the service before it even got off the ground. The site now displays a notice explaining that it has been permanently shutdown. This site has been removed by BREIN because it supplies illicit entertainment content. This website made use of an illegal online supply of films and television series. Uploading and downloading of illegal content is prohibited by law and will therefore result in liability for the damages caused. SUPPORT CREATIVITY Go to Thecontentmap.nl and see where you can legally download and stream BREIN says it contacted the site’s host who in turn contacted the site’s owner, who took NachoTime down immediately. TorrentFreak contacted BREIN chief Tim Kuik and put it to him that his group has just taken down the best looking site around. “I agree, very well presented,†Kuik said. “A pity it was illegal.†The reaction to NachoTime’s arrival by BREIN was particularly quick. That, Kuik says, is due to the nature of these new waves of PopcornTime-like services. The anti-piracy group says it views them as a greater threat than torrent sites. “Their ease of use makes them very popular so they are hurting the growth of legal online platforms,†Kuik explains. What will happen to the individual running the site isn’t clear, but Kuik told us that he’s a 22-year-old from the Dutch city of Utrecht who signed a declaration to keep the site offline. His quick response appears to have been well received by BREIN but others thinking of embarking on the same kind of project are already on a warning. “They will be offered a settlement or they will be sued,†Kuik explains. “Settlement is a cease and desist undertaking with a penalty sum, a BREIN text on the site referring to Thecontentmap.nl that lists legal online platforms and payment of compensation depending on circumstances. A court case would include an injunction and full costs (likely between € 8,000 – 15,000) and a procedure on the merits regarding damages and again full costs.†While Popcorn and Nachos are definitely tasty snacks for pirates, at least one is currently off the menu.
