  3. Spotify is generally hailed as a piracy killer, with music file-sharing traffic dropping in virtually every country where the service launches. However, much of this effect may be lost if recent calls to end Spotify's free tier are honored. When Spotify launched its first beta in the fall of 2008, we branded it “an alternative to music piracy.†With the option to stream millions of tracks supported by an occasional ad, or free of ads for a small subscription fee, Spotify appeared to be a serious competitor to music piracy. In the years that followed Spotify conquered the hearts and minds of many music fans. Currently available in more than 60 countries, the service has amassed dozens of millions of users. It’s a true success story, and one that led to a decline in music piracy rates in a few countries, exactly as planned. However, in recent months there have been calls to end Spotify’s free ad-supported service. Some prominent musicians and labels believe that killing the free tier will increase revenues. This week it was revealed that Apple is also pressuring record labels to end the licensing agreements that allow Spotify’s ad-supported deal, presumably to make its own Beats service more competitive. While Spotify hasn’t signaled that anything will change, killing the free version will be a dangerous move. In fact, it’ll be a step backward that is likely to increase piracy in the long run. Sure, when free users are forced to pay it will motivate some to sign up for a paid subscription. This will then lead to more revenue in the short term, something labels and artists will appreciate. However, in the long run the effects may not be so positive. One of the main appeals Spotify has for the public, specifically ‘pirates,’ is that there’s a free version available. Pirates like to try before they buy and Spotify free removes the giant hurdle to make the switch to a legal streaming service. Those who then like the service and want the ad-free experience will eventually convert to a paid subscription. After all, paying is not a problem for most ‘pirates’ who tend to spend more money on entertainment than the average consumer. Ultimately, the goal of the free version is to start changing the habits of pirates, and it’s been pretty successful at doing so. Besides killing the free version of Spotify there’s also a possibility that it may become more limited. Just before the weekend news broke that Apple’s Beats may also offer some content for free, and perhaps they would like Spotify and others to do the same. Again, this isn’t a particularly good idea. The magic of Spotify is that users can access a virtually unlimited library of music. A library that’s greater than what people can find on most pirate sites, and more convenient too. Limiting the library for free users will make it look less attractive compared to the pirate alternatives. As a result, people will be less likely to get hooked and less likely to make the switch to becoming a paid user. This brings us to the exclusivity issue. In recent years the music industry has excelled in making its music available to as many people as possible, often without restrictions. But now that some big artists are removing (or threatening to remove) their music from Spotify, or offer some content exclusively to other services, the overall appeal is waning. Music fans don’t want to pay for 3, 5 or 10 services to get all the music they love. They want it all in one place. While this may not bring in as much as everyone would like, it’s a crucial part of stamping out music piracy. A few months ago a movie industry report found that consumers in the UK need to use dozens of movie services if they want access to the most popular films. If the same happens to music, piracy will surely soar. All in all it’s safe to conclude that exclusivity breeds pirates.   5. California-based Netflix is preparing a bold step by absorbing a former arch rival into its service. In a deal reported to be worth $11.5 million, Netflix and Popcorn Time talent will combine to re-market the latter as a Spotify-like 'free tier' enhancement to the full premium Netflix service. Over the past year the rise to fame of Popcorn Time has become one of the video entertainment industry’s hottest topics, with various iterations of the project becoming huge successes in their own right. Of course, this fame has put the Popcorn Time brand on a collision course with content creators and distributors, with numerous threats of legal action regularly making the headlines. However, behind the scenes a different end game has been in the planning for some time. Popcorn Time has become almost universally known as the ‘Netflix for Pirates’, a moniker that eventually led the California-based streaming service to refer to Popcorn Time as a competitor earlier this year. The admission was the first time that the company had noted synergies with its pirate counterpart and one that signaled the arrival of today’s announcement. TorrentFreak can now reveal that Netflix has struck a surprise deal with the people behind PopcornTime.io, one of the leading Popcorn Time forks. It marks the end of litigation threats and a move towards cooperative development. While the price tag is relatively modest at just $11.5m, Netflix has big plans for Popcorn Time that have already been tried and tested in the music industry. Noting that Spotify now has 60 million users operating on its free tier and more and more choosing to upgrade every month, Netflix intends to leverage the ‘cool’ reputation enjoyed by Popcorn Time to attract paying users to its premium service. popcorn“Today we’re here to announce that Popcorn Time has been acquired by Netflix for $11.5 million. While to many of you that may come as a surprise, and worry that Popcorn Time will change because of this, you don’t need to worry,†the Popcorn Time team said in a statement. “Popcorn Time itself won’t change to the users, it will still be the same app you’ve all come to love over the last year. However, working with Netflix means we can develop updates and fixes faster and bring you new features more regularly.†While its understood that Netflix designers and engineers will have both creative and technical input into the development of Popcorn Time moving forward, the current team will continue to work on the project to ensure users’ needs are met. “The current team will continue to work on Popcorn Time as always. Our goal has always been about bringing you the latest content at home as quickly as possible with all the great features you’ve come to love,†the team say. While the deal appears to have been sealed in the past few days, TF sources say that the whole thing was close to collapse only last month. In an eleventh hour move, Netflix negotiators demanded that the open source PopcornTime.io project become closed source in all future releases. An outraged team reportedly threatened to pull out, rejecting the $50m offer that had originally been on the table. Eventually a compromise was reached but it resulted in a near $40m reduction in Netflix’s offer, “a price worth paying†according to the team who insist that open source principles come first. All money received from Netflix will be returned to the project over the next several years.   6. The South by Southwest (SXSW) music festival is one of the largest and most popular in the United States. For more than a decade SXSW has been sharing DRM-free songs of the performing artists, 55 GB worth so far. This year's release is the largest thus far with 1,291 tracks totaling more than eight gigabytes. Since 2005 the SXSW music festival has published thousands of DRM-free tracks from participating artists. For some of the first releases the festival organizers created the torrents for the artist showcases themselves, but since 2008 this task has been in the hands of the public. In 2014 SXSW replaced the MP3 files with Soundcloud links, which complicated the archiving process. Luckily, this year all of the regular SXSW showcase MP3s are freely available again on the festival site for sampling purposes. In common with previous years, Ben Stolt has taken the time and effort to upload all of the MP3s onto BitTorrent with proper ID3 tags. The 2015 release is out now and comes in two torrents containing 1,291 tracks. That’s 8.42 gigabytes of free music in total, which is a new record. “These torrents include tracks that can be previewed on the SXSW website for SXSW 2015. This year’s includes 1,291 files totaling 8.42GB, making it the largest to date,†Stolt notes. All the tracks released for the previous editions are also still available for those people who want to fill up their MP3 players without having to invest thousands of dollars. The 2005 – 2015 archives now total more than 55 gigabytes. Every year SXSW torrents are a great success, with many thousands of music aficionados downloading gigabytes of free music across virtually every genre from both established acts and upcoming bands.   7. In recent weeks customers of UK ISPs have received letters from copyright trolls demanding settlement for alleged downloading of movies. Today they can fight back. Southampton-based lawyer Michael Coyle informs TorrentFreak that if the accused make a charitable donation in support of his London Marathon run, he will provide his time for free. Early March, US-based company TCYK LLC began demanding cash from customers of the UK’s second largest ISP, Sky Broadband. In 2014 TCYK monitored BitTorrent swarms for individuals sharing their movies without permission and eventually forced Sky to hand over the alleged file-sharers’ personal details. Virgin Media customers were targeted by an almost identical wave of letters shortly after, this time sent by well-known copyright troll outfit Mircom. Representing several overseas porn companies, Mircom also want cash to make supposed lawsuits go away. This week the latter case provided a sinister twist. After TF revealed that Mircom was trying to hide its identity from its domain WHOIS, a reader reported the company to domain registry Nominet. Soon after Mircom.co.uk revealed its true operator to be GoldenEye International, another copyright troll outfit that had featured in previous UK cases. Emails currently being sent to letter recipients also confirm that GoldenEye are handling their claims. The apparent murkiness of these cases only adds to the anxiety of letter recipients, but today they have some good news. Michael Coyle of Southampton-based Lawdit Solicitors informs TorrentFreak he will give his time for free to defend those accused. Coyle is one of the most experienced UK-based solicitors in the file-sharing arena. Since 2008 he has spoken with or acted for more than 700 individuals who have received so-called Letters of Claim, including those involved in the infamous ACS:Law case that ended with solicitor Andrew Crossley being severely disciplined. Coyle says he expected that affair to signal the end of ‘trolling’ in the UK but recent events have sadly proven him wrong. “I am a Copyright Solicitor and regularly enforce copyright where it has been infringed. People should respect the copyright of third parties. However, are some copyright holders abusing the great British public?†he questions. The general consensus to that proposition is yes, most likely. And according to Coyle there is serious money involved. “The amounts are quite staggering. In the most recent campaign 2500 letters were sent out. Typical sums demanded are in the range of £500 to £1000. If everyone pays say £700.00 this would generate £1,750,000 which is not bad even for the porn industry.†“The tactic is to scare people into paying the sums by threatening to issue court proceedings. If this does not work, proceedings are not normally issued,†says Coyle quoting Justice Arnold who dealt with previous cases. “This is because the economic model for speculative invoicing means that it is more profitable to collect monies from those who pay rather than incur substantial costs in pursuing those who do not pay in court. Where proceedings are issued, they are not pursued if a default judgment cannot be obtained.†By now this strategy is relatively common knowledge to those following these cases, but for those targeted the experience can be a painful one. “The whole process is indiscriminate and causes immense worry and suffering. It’s frustrating and brings the whole concept of protecting your copyright in to disrepute,†Coyle says. So, with this in mind, he’s stepping up to help level the playing field. “I’ve decided to act [by offering time for free] and hopefully my small input along with consumer groups can persuade the Courts to prevent such conduct. However I suspect that it will require parliament to effect any change,†he adds. So, faced with the dilemma of whether to go it alone, pay up, or seek legal advice, those in receipt of a letter can now take the latter option for free, albeit it with a minor string attached. Coyle is a regular runner of the London Marathon and has raised thousands for children’s charities while doing so.   8. Are you located in China, running a pirate version of Windows 7 or Windows 8 but fancy a shiny new version of Windows 10 instead? Well, your luck is in as Microsoft says it will give even the most piratical of Chinese users an upgrade copy of its next operating system for the bargain price of absolutely free. The Chinese are known for duplicating just about anything, from entire Apple stores to some of the world’s most famous cars. Nevertheless and seemingly against the odds, easily copied items are doing well through official channels. China reportedly fueled record global box-office revenues in 2014 and even has official Hollywood movies available online before they air in the United States, ostensibly to beat piracy. And today brings yet more good news for Chinese citizens who prefer not to pay for their content. When it arrives later in the year, Microsoft are going to gift free upgrades of Windows 10 not only to those who purchased Windows 7 and Windows 8, but also to those who pirated them. Speaking from the WinHEC technology conference in Shenzhen, China, Terry Myerson, who runs Microsoft’s operating systems unit, said the plan was aimed at bringing the currently non-paying back on board. “We are upgrading all qualified PCs, genuine and non-genuine, to Windows 10,†Myerson told Reuters. “The plan is to ‘re-engage’ with the hundreds of millions of users of Windows in China,†he said. In January this year Microsoft said it would offer free upgrades of Windows 10 to legitimate users of Windows 7 and Windows 8 but this is the first time that pirates will be given an official free pass. The big question now is how this news will be received in the West. In the United States, for example, pirate users of Windows 7 and 8 will be expected to pay top dollar for Microsoft’s newest OS if they too want to jump aboard the legit train. That may raise hackles. However, the fact that Chinese pirate users will get a free upgrade of Windows 10 could open up avenues for Western pirates to masquerade as their Eastern counterparts in order to avoid paying. Exactly how that will play out will remain to be seen, but it’s more than likely that a ‘pirate’ solution will be found, one way or another.   12. Ubisoft's free game offer that serves as an apology for Assassin's Creed Unity's launch troubles comes with one major stipulation. Those who claim a free game, according to the fine print, are agreeing to never sue Ubisoft over Unity's woes or the now-diminished value of the game's DLC pass. Game Informer spotted the important legal terms, which you can read in full at the bottom of this post. To sum up briefly, it says that by accepting the free game, you're waiving the right to sue Ubisoft or any of its divisions, either through a solo lawsuit or as part of a class-action legal battle. This kind of measure is not uncommon in gaming. In fact,Xbox Live, PlayStation Network, and Steam all have similar legal terms in place that block class-action suits. Unity's launch in November was marred by a long list of technical troubles, most of which, however, havesince been fixed through subsequent patches. Just before Thanksgiving, Ubisoft announced the free game offer, allowing anyone who bought the game's DLC pass to choose a free game from a list that includes some pretty great games. If you didn't buy the DLC pass (and it's since been removed from sale), you're still getting free content in the form of the Dead Kings expansion. Xbox One owners with an Xbox Live subscription will be able to download D4, which normally sells for $15, for free starting January 1. Meanwhile, Xbox 360 users can pick up MX vs. ATV Alive (normally $20) for free January 1-15, and then The Witcher 2 (normally $30) January 16-31. Now is also a good time to download EA Sports' extreme snowboarding game SSX, which is free on Xbox 360 through December 31.   15. Disney has just obtained a patent for a search engine that ranks sites based on various "authenticity" factors. One of the goals of the technology is to filter pirated material from search results while boosting the profile of copyright and trademark holders' websites. Disney and other rightsholders are not happy with today’s search engines after repeatedly asking Google and Co. to promote legal content and remove pirate sites from search results. While Google implemented several changes to satisfy these requests, Disney has also taken matters into its own hands. A new patent awarded to Disney Enterprises this week describes a search engine through which pirated content is hard to find. Titled “Online content ranking system based on authenticity metric values for web elements,†one of the patent’s main goals is to prevent pirated movies and other illicit content from ranking well in the search results. According to Disney their patent makes it possible to “enable the filtering of undesirable search results, such as results referencing piracy websites.†Disney believes that current search engines are using the wrong approach as they rely on a website’s “popularity.†This allows site owners to game the system in order to rank higher. “For example, a manipulated page for unauthorized sales of drugs, movies, etc. might be able to obtain a high popularity rating, but what the typical user will want to see is a more authentic page,†they explain. While this is a rather simplified description of the complex algorithms most search engines use, Disney believes it can do a better job. In their patent they describe a system that re-ranks search results based on an “authenticity indexâ€. This works twofold, by promoting sites that are more “authoritative†and filtering out undesirable content. “In particular, embodiments enable more authoritative search results … to be ranked higher and be more visible to a user. Embodiments furthermore enable the filtering of undesirable search results, such as results referencing piracy websites, child pornography websites, and/or the like,†Disney writes. While Disney’s idea of a search engine may sound appealing to some, deciding what counts as “authoritative†is still rather subjective. Google, for example, uses PageRank which is in part based on the number of quality links to websites. Disney, however, suggests giving “official†sites priority when certain terms relate to a property of a company. These “authority†weights can include trademarks, copyrighted material, and domain name information. This doesn’t only affect pirated content, Disney explains, it also means that a Wikipedia entry or IMDb listing for “Snow White and the Seven Dwarfs†will rank lower than the official Disney page of the film. “The Disney.go.com web page may be associated with an authenticity weight that is greater than the authenticity weight associated with the encyclopedia web page because Disney.go.com is the official domain for The Walt Disney Company. As such, with respect to the Snow White and the Seven Dwarfsâ„¢ film, the Disney.go.com web page may be considered more authoritative (and thus more authentic) than the encyclopedia web page,†Disney writes.   16. Subscription fees now mandatory for music streaming service. The free version of Xbox Music, Microsoft's Spotify-like streaming service, will be axed within weeks. Following the removal of the ad-supported free version, on December 1, the only way to access Xbox Music will be to sign up to a paid subscription. Users will have unlimited access to Microsoft's library of millions of tracks, providing they pay $10 (or £9) per month. "We are focusing Xbox Music to deliver the ultimate music purchase and subscription service experience for our customers," the corporation said on its FAQ page. There was no further explanation as to why the company is abandoning its ad-supported service. The move comes despite one of the leading music streaming services, Spotify, continuing to offer limited music access for free. For the monthly fee, Xbox Music offers unlimited access to its music servers, as well as offline listening on PC, tablet, and smartphones. Interactive Entertainment has released free DLC for Middle-earth: Shadow of Mordor available today that lets players take control of a new character. You can now download the The Power of Shadow bundle, which allows you to take on the appearance of Sauron's servant, the Black Hand. The new playable character, who's an antagonist in the regular game, comes with three new Epic Runes that grant you new abilities. The One with Nature Rune makes you immune to poison attacks from Ukuk Captains or Ghuls. The Ascendant Rune give you double focus time for slow motion ranged combat. The Elven Grace Rune increases defense, which halves the damage of enemy strikes. Last week, the game was updated with a free photo mode, which allows you to remove the UI from the screen, capture an image, and tweak various settings--depth of field, tilt, field of view, etc. Shadow of Mordor was released in September to a positive reception on Xbox One, PlayStation 4, and PC, and you can read our review here.   18. Developer apologizes for keeping fans waiting; Connection problems persist during peak hours. Evolution Studios, the developer responsible for Driveclub, has apologized to fans for the lack of information regarding the delayed PS Plus edition of the PlayStation 4 racer. Driveclub's launch two weeks ago was marred by severe connection problems due to errors within the game's netcode, which Evolution has attempted to remedy ever since. Prior to the release of Driveclub, Evolution and Sony had agreed to release a free abridged version of the game to PS Plus subscribers, which was scheduled to go live in early October. However, due to the online connection problems, coupled with the likelihood that a surge of new players would make matters worse, Sony decided to postpone the PS Plus edition. It is still unclear when the PS Plus edition will be released, and on Monday, Evolution posted an apology on its Facebook page for the lack of updates on the matter. "The PS Plus Edition news will come as soon as we have concrete info--sorry to keep you all waiting," the studio wrote. Representatives for Evolution have since been proactive in engaging with the community, frequently updating its Facebook fan page and releasing several patches to help restore connections. It was hoped that the latest patch, released over the weekend, would be a breakthrough for the game. But Evolution now says the outcome was not quite as successful as it hoped. "We can see that the majority of you can now get online, but we know that at peak times of the day it can still be hard to get connected, so we are still working to improve connectivity with every update to the servers," the Sony owned studio wrote. "We can also see that when you do get connected, some of you are having a hard time getting into multiplayer races and that posting leaderboard results can sometimes take a lot longer than you'd expect. "These connectivity issues stem from the same unforeseen server problem that we've been working to get on top of since we launched Driveclub, and while we are getting on top of the problem now, we are still working round the clock to keep improving gameplay for you."   19. If you've pre-purchased Beyond Earth, you can begin preloading it on Steam now. The latest game in the Civilization series, Civilization: Beyond Earth, launches later this week. Preloading has begun, but one thing you may want to download first is Civilization V, which you can play for free from now until Thursday. Anyone with a Steam account can now download Civ V for free and play it until Thursday, October 23 at 10 am Pacific. That's hardly enough time to spend with a game that can easily eat up hundreds of hours of your life, but it's a good way to kill time between now and Beyond Earth's release this Friday, October 24. If you've already pre-purchased Beyond Earth on Steam, you can begin preloading the game now so that it's ready to go as soon as possible on Friday. The exact times for when it will unlock for Steam buyers haven't yet been announced, but 2K says it'll be sharing those "soon" for everyone around the world. Prior to the release of the PlayStation 4 racing game, Evolution and Sony had agreed to release a free abridged version of the game to PS Plus subscribers. However, due to major server problems affecting the game, coupled with the likelihood that a surge of new players would make matters worse, Sony decided to postpone the PS Plus edition. But on Monday Evolution Studios claimed it had begun to gain ground in restoring full online services for the racing title, and four days later it has released another update (1.04) which it hopes will bolster online stability even further. "More servers and new upgrades are still coming online hour-by-hour, so we expect improvements to server connectivity and reliability for everyone," the studio wrote on its Facebook page. "Essential diagnostics are still running periodically (for the next 12 hours) to help us continue to improve server performance," it added. "We are still also working hard to get the PS Plus Edition of Driveclub out as soon as possible and hope to update you on this soon." The studio has apologised on several occasions for the downtime, and hasn't ruled out compensating those affected by the problems. Did the recent release of Alien: Isolation stoke your desire for more extraterrestrial adventures? GOG.com is hoping to scratch that itch with their most recent promotion: you can download Aliens vs. Predator forfree from the company's site. Available until Friday, the classic FPS is also a way for GOG to test their Galaxy multiplayer client. In a press release, GOG VP of online tech wrote, "We're ready to take in more gamers, and AvP seemed like a natural choice: it's high up on our community wishlist, and it's definitely one of the all-time best FPS titles. It also allows for testing Galaxy in a more dynamic environment." This month marks the three-year anniversary of the game (and, by extension, the series), which debuted on October 18, 2011. Overkill has been trying to attract players to join the official Payday 2 group on Steam, offering various in-game rewards as milestones were reached. This includes "secret stuff" that remains in development and will be given away for free once it's ready. Because the goal of 1.5 million was reached sooner than expected, Overkill will give away the original Payday sooner than it was planning.   23. Download your free copy of the first Dragon Age game now. The latest game in EA's On the House promotion is a good one: Dragon Age: Origins. Beginning today, you can download it for free through Origin. Origins is the first game in the Dragon Age series, having launched on Xbox 360, PS3, and PC back in 2009. It was very well-received upon its release, earning a 9.5 in GameSpot's review thanks to its enjoyable combat and excellent story. This free copy of Origins comes in time to give you just over a month to play it before the arrival ofInquisition, the third game in the Dragon Age series. That game brings back a major aspect of combat that was abandoned in Dragon Age II, the tactical view. It will also feature a way of importing your choices from the first two games, though you won't do so by importing a save file (so don't worry if you play Origins on PC and Inquisition on consoles). Some will bemoan needing to use Origin, EA's Steam-like digital platform, but this is a free game (regularly priced at $20) with no strings attached. Previously, we've seen games like Dead Space and Wing Commander III given away, and you can still get the most recent On the House game--Bejeweled 3--for free right now.   24. Developer Evolution Studios apologises as servers buckle under demand. A free PlayStation Plus edition of Driveclub has been delayed across the US and Europe, the game's developer has confirmed. An abridged version of the PlayStation 4 racing title--which is free to PlayStation Plus subscribers--was scheduled to unlock in North America on Tuesday and across Europe on Wednesday, but neither appeared. Now, in a new blog published on DriveClub's official Facebook page, the game's director Paul Rustchynsky explained there will be a delay to the free version. Rustchynsky said the delay is necessary because server problems are affecting the game already. "We are seeing a lot of activity and new social behaviours right now, but unfortunately this is pushing the servers to their absolute limits," he wrote. "We are sorry if you are having a hard time getting online as we know many of you are. Please be aware that the game will automatically keep trying to connect you. Once you're online, you should have no further problems during your session." He explained that the game's developer, Evolution Studios, is working on a number of patches to eliminate the problems. "In order to help all Driveclub players who have the game already, we're temporarily holding back the PS Plus Edition and the My Driveclub app to ease the load and traffic to the servers," he added. "This should give players a better chance of connecting to the game servers." The full, paid-for version of Driveclub released across North America on October 7 and in the UK on October 10. GameSpot's Driveclub review was somewhat disappointed by the game, suggesting it makes no bold advances in the racing genre. To add to Evolution Studio's troubles, players have begun to report problems getting online, being shown instead a "Fault With Your Internet Connection" error code. "To our PS Plus fans, we're sorry you're having to wait longer to play, but we want to ensure that when you come on board, you get the best experience possible," Rustchynsky added. "Rest assured, if you've pre-ordered the full game upgrade from the PS Plus Edition, you will still get the full version of Driveclub digitally, and if you can't get online you'll be able to get started offline like everybody else with single player mode as you start your Driveclub tour. "We fully appreciate how frustrating this is for everyone. We want you to get online with your club because racing, challenging and having fun together is what the game is all about. We know that racing with your friends online is what you’ve been waiting for and we are doing everything we can to deliver that experience to you as soon as possible.
