After being arrested and jailed in Morocco last October, the alleged "mastermind" behind private torrent tracker DanishBits has now been extradited to Denmark. Following a hearing at the Copenhagen City Court last week, the man was remanded in custody for 25 days. danishbitsAfter establishing itself as one of the leading private torrent trackers on the web with millions of visits per month, it was only a matter of time before DanishBits attracted the attentions of the authorities. Indeed, Danish anti-piracy group Rights Alliance quietly reported the site to local police as far back as 2016 but although the wheels of enforcement can move slowly, during the last quarter of 2020 significant progress towards dismantling the operation was made public. DanishBits Owner Arrested During October 2020, DanishBits – which was extremely popular in its home territory – suddenly became unreachable. A source close to the site informed TorrentFreak that one of the site’s owners had been arrested earlier in the month, with the downtime attributed to that person’s predicament. By December 2020, the situation surrounding DanishBits was becoming more clear. Denmark’s State Prosecutor for Serious Economic Crime (SØIK) revealed that a 33-year-old Danish man had been arrested in Morocco, following an investigation prompted by a formal complaint from local piracy group Rights Alliance. The still-unnamed individual, who was labeled as the alleged DanishBits ringleader, was temporarily jailed in Morocco, pending an extradition process aimed at returning him to Denmark to face trial. Extradition to Denmark Actioned Quickly Extradition cases involving alleged copyright infringers are relatively rare. Kim Dotcom, for example, is still fighting extradition in New Zealand nine years after his original arrest. George Bridi, allegedly a former key player in the SPARKS release group, is believed to be still in Cyprus awaiting extradition to the United States after being arrested last August. For the alleged operator of DanishBits, however, things have moved much more quickly. According to a new announcement from Special prosecutor Dorte Frandsen at SØIK, the 33-year-old ‘ringleader’ of DanishBits is now back on Danish soil after a successful extradition process. During a hearing at the Copenhagen City Court last Thursday, he was remanded in custody for 25 days. SØIK: Hiding Abroad Offers Little Protection “We consider the 33-year-old as the mastermind of an extensive file-sharing network,” Frandsen says. “The case is still being investigated, and one should not think that one can hide abroad and thus avoid being brought to justice. International co-operation works, and there is a risk of being imprisoned for a long time abroad.” In response to the development, Rights Alliance Director Maria Fredenslund welcomes the efficiency of the SØIK Intellectual Property Rights Taskforce in returning the defendant to Denmark to face trial. “It is enormously satisfying for the rights holders to experience how SØIK strikes against Danish suspects both inside and outside Europe. It sends a clear signal that the criminals cannot hide – not even outside Denmark’s borders,” Fredenslund says. “It is really an excellent effort from both SØIK, the National Cyber Crime Center (NC3) of the National Police, and from the police authorities of the other countries involved.” NordicBits: No Extradition Due to Sombre Circumstances Back in 2018, Rights Alliance also reported another private tracker to the authorities. Albeit with a lower member count of around 5,000, NordicBits was still considered a player in the region and a 69-year-old man was ultimately identified by the authorities as its operator. Following action by SØIK, he was questioned and charged by police in Spain last September. “He admitted to being behind the scenes and then helped to close the file-sharing service,” SØIK adds, confirming earlier reports. “This put an immediate stop to the illegal sharing. The accused person was seriously ill at the time of the charge and subsequently passed away before the case came to court.” Both Sites Were Operated Professionally SØIK says that according to its investigation, carried out in conjunction with the National Police’s National Cyber Crime Center (NC3) and police authorities in other countries, both DanishBits and NordicBits were professionally operated. “oth the administrators and the users made great efforts and were very aware of to hide their true identity – for example, by paying with cryptocurrency,” SØIK notes. Rights Alliance and SØIK: Acting Quickly to Stop Pirates But while DanishBits and NordicBits have already been consigned to history, the war against file-sharing sites in Denmark is ongoing. Two other sites – Asgaard and ShareUniversity – previously opened their doors to new members following the closure of the shuttered sites. However, their enthusiasm to take up the slack was cut off in its prime following threats from Rights Alliance, leading to both shutting down prematurely and further arrests. Rights Alliance has been making its position clear for some time – new entrants to the file-sharing market will not be tolerated. SØIK says that there is more work to be done. “The investigation of file-sharing cases continues by SØIK’s special IPR unit (Intellectual Property Rights), which is a national unit that investigates and prosecutes violations of the Trademark Act, the Copyright Act, the Design Act, the Patents Act and the Radio and Television Act,” the agency concludes

One of the ringleaders behind the defunct torrent tracker DanishBits received a one-year prison sentence today, of which nine months are conditional. The 33-year-old man was arrested in Morocco last year and later extradited to Denmark, where he admitted his involvement with the site. Over the past several months, Danish law enforcement authorities effectively shut down the thriving local torrent tracker scene. It started in September and October 2020 when DanishBits and NordicBits went offline after their operators were caught. Torrent Tracker Crackdown As is often the case, it didn’t take long before other sites stepped up. Rival trackers such as “Asgaard” and “ShareUniversity” opened their doors to new members, resulting in an explosive growth of these sites. This bonanza only lasted for a few weeks. The Danish Government’s SØIK’s IP-Task Force kept the pressure on, with help from local anti-piracy group Rights Alliance. Soon after, these sites shut down as well, with the operators and users risking prosecution. The strong language wasn’t just a warning. Last month we reported that a user of the DanishBits tracker was handed a conditional prison sentence of 60 days for sharing hundreds of movies and more than a thousand TV episodes and audiobooks. DanishBits Ringleader Sentenced Today, SØIK and Rights Alliance announced another victory that leads back to where it all started. The Copenhagen City Court handed the operator of DanishBits a one-year prison sentence, of which nine months are conditional. The 33-year-old Dane was arrested in Morocco last October and was extradited to Denmark last month. The man admitted his wrongdoing which, in addition to the prison sentence, also results in 150 hours of community service. The authorities describe the man as one of the “ringleaders” who, together with others, earned over $160,000 in revenue. The operator’s cut was roughly $40,000, which he will have to pay in damages to Rights Alliance. According to SØIK special prosecutor Dorte Frandsen, the man played a very substantial role. Among other things, he helped to program and operate the DanishBits tracker. “He had a very significant role in running the website, which gave many thousands of Danes the opportunity to download illegal material,” Frandsen says. “In light of the very extensive role as a ringleader, I am satisfied with the relatively harsh prison sentence that he has been sentenced to today.” Deterring Others Rights Alliance director Maria Fredenslund is also happy with the sentence. She hopes that it will deter others from getting involved in similar sites. “It is extremely important that examples are set which show that it does not pay to be a criminal,” she says, noting that copyright holders have been plagued by piracy for many years. “Therefore, it is crucial that clear signals are now being sent that piracy is illegal and that breaking the law has consequences. We have a highly professional unit in SØIK’s IP-Task force, which has again done a fantastic job,” Fredenslund adds. As reported previously, similar enforcement actions have shut down all sizable torrent trackers in Denmark. However, that doesn’t mean that copyright infringement is no longer a problem. Data from piracy tracking firm MUSO shows that the number of Danish visits to pirate sites has only increased in recent months.

Following the dismantling of several private trackers in 2020, a man has been sentenced for sharing thousands of TV shows and movies via now-defunct torrent site DanishBits. Sites like DanishBits and Nordicbits were considered relative safe havens for thousands of individuals looking to share copyrighted content in a more closely controlled environment. But under the surface, dangerous undercurrents were beginning to swell. Investigations into both sites were well underway and in October DanishBits shut down, closely followed by Nordicbits. Operators of both sites were arrested, one in Morocco (who has now been extradited to Denmark) and one in Spain, but the question remained whether users of these and similar sites would find themselves in the firing line. User of DanishBits Convicted in Odense This week, a 35-year-old man was convicted of copyright offenses at a court in Odense, the third-largest city in Denmark. The individual was a user of DanishBits and according to the prosecution, his activities were considerable. The man was accused of downloading (and in some cases sharing) hundreds of movies and thousands of TV shows via the site. Movies played a relatively minor part in the case, with 579 titles said to be infringed, but TV shows played a much bigger role. In total, the DanishBits user was said to infringed copyrights in 2,453 episodes spanning 69 TV series. Additionally, the man was accused of sharing 1,670 audiobooks. Given the scale of the infringing, the court went relatively lightly when it came to sentencing, handing down probation rather than an immediate custodial sentence. Local anti-piracy group Rights Alliance, which was involved in the investigation and reported the user to the State Prosecutor for Serious Economic Crime, welcomed the sentence. “Rights Alliance reported the user in question to SØIK on the basis of an investigation into the file-sharing network DanishBits. In addition to 60 days’ conditional imprisonment, the convicted person can look forward to having to pay compensation to the Danish rights holders,” the group said in a statement. Another Piracy Conviction in Copenhagen Earlier this month the conclusion of another file-sharing case was reported by SØIK. Following a process at the Copenhagen City Court, a 35-year-old man was convicted of downloading and sharing 9,440 movies. According to SØIK, the movies were made available “to at least 21 users via a server” and for this offense, he was sentenced to 30 days probation. TorrentFreak requested additional information from anti-piracy group Rights Alliance which has now revealed a completely different type of case. In December 2019, Rights Alliance filed a criminal complaint against a Denmark resident after discovering he was running a Plex server containing copyrighted content. “It was a Plex server running on a NAS-server and operated from a Mac Mini. The owner and operator of the Plex server shared the content with friends and family. They were sent a password by mail,” the group explains. While the Plex software is entirely legal, like other media software it can be put to illegal uses. Prosecutions are extremely rare, especially when people only share their libraries with close friends and family, but in this case Rights Alliance felt a criminal case was warranted. TF asked Rights Alliance if those who accessed the server face any action but the group would only confirm that they were users of the server. Meanwhile, the convicted operator must pay for the legal proceedings and abide by a settlement agreement with rightsholders, the terms of which remain confidential. Rights Alliance Had Promised to Focus on Persistent Pirates Last December, following the closure of DanishBits and Nordicbits, Deputy Police Inspector Michael Lichtenstein said that while it was important to shut down sites, data seized as part of those operations could lead to users being tracked down too. In January 2021, Rights Alliance added that persistent pirates would indeed face prosecution. It’s certainly possible that this week’s conviction represents the start of that work but it’s unclear how many more cases might be in the pipeline. Nevertheless, Rights Alliance is now doubling down on its warnings. Commenting on the sentencing this week in Odense, the anti-piracy group says that the prosecution illustrates that SØIK is focusing on users who repeatedly share copyrighted content online. “When you repeatedly see this group of users stubbornly stick to their illegal sharing of movies, series, literature and articles, despite the police interference on several occasions, we are pleased that SØIK has sharpened their focus on these persistent criminals,” says Rights Alliance director Maria Fredenslund. “It must never pay to be a criminal,” she adds.

Police, meanwhile, aren't ruling out the possibility that users of the site will be identified. Private BitTorrent trackers are niche sites in most parts of the world but in Denmark they are huge. With millions of views per month, sites such as ShareUniversity and Asgrd are among the most popular sites in the country. This was also the case with DanishBits until it suddenly went offline a few weeks ago. At the time, several sources informed us that the owner was arrested and, this week, official confirmation came in that this is indeed the case. Danishbits Operator Arrested Denmark’s State Prosecutor for Serious Economic Crime (SØIK) announced that a 33-year-old Danish man was arrested in Morocco. This followed an investigation by the authorities, which acted based on a complaint from local anti-piracy group Rights Alliance. The Danishbits investigation, which started in 2016, revealed that the site was run professionally and that the people involved did their best to hide their identities. Payments, for example, were made through cryptocurrency. Despite these efforts, law enforcement officials managed to identify the operator, who was subsequently placed on Interpol’s wanted list. In October, the alleged ringleader of the site was eventually apprehended and jailed in Morocco, from where he will possibly be extradited to Denmark. “It’s very satisfying that the investigation led to both the arrest of the suspected operator and shutting down the network. It succeeded thanks to the sustained collaboration between our specialized investigators, prosecutors, and IT experts,” says Deputy Police Inspector Michael Lichtenstein. Nordicbits Shut Down, Operator Passed Away Danishbits was not the only private tracker to disappear this fall. The same happened to Nordicbits. This site, which was smaller than its competitor, was also reported to the authorities by Rights Alliance in 2018. After a detailed investigation, the authorities identified a 69-year-old Danish man as the operator. The man, who resided in Spain, was apprehended by local police in September. After being questioned the Nordicbits operator admitted his involvement in the site and agreed to shut it down voluntarily. The Danish prosecution intended to take the operator to court. However, the man was seriously ill and recently passed away. Targeting Users? In both cases, law enforcement officials managed to seize data which will be used for further investigation. Deputy Police Inspector Michael Lichtenstein doesn’t rule out that users will be identified as well. “The most important thing is clearly to stop the illegal services, but it can certainly not be ruled out that seized data can lead to the identification of the users of the two illegal networks,” he says. Despite this warning, private torrent trackers continue to flourish in Denmark. The two sites that were shut down had roughly 45,000 registered users, many of whom went to other Danish trackers. Rights Alliance says that the users of these sites know all too well that they are breaking the law. The anti-piracy group is also happy that the authorities will consider follow-up steps. “We are pleased that the announcement of the State Prosecutor for Serious Economic Crime also reflects the importance of an increased focus on users’ illegal behavior,” Right Alliance CEO Maria Fredenslund says. Thus far, however, these users don’t seem to be particularly bothered. After the shutdowns ShareUniversity saw a 500% increase in visits, and Asgrd’s traffic jumped up by more than 750%. Right Alliance informs TorrentFreak that they are aware of the growth of these sites and urges them to give up their illegal activities. While the operators were initially excited to see the community grow, recent news about the prosecution of their former competitors changed things. With legal pressure mounting, the tracker's staff are no longer willing to take the risk and the site will shut down at the end of the year. In recent months Denmark has lost two of its most popular pirate sites following police investigations. Both Danishbits and Nordicbits went offline after the alleged operators were caught. This was a big hit to Danish torrent users, who generally prefer private torrent trackers over public indexers such as The Pirate Bay. As is often the case with shutdowns, other sites have stepped in to take up the slack. For example, following the closure of Danishbits, both ShareUniversity and Asgaard opened their doors to members who were looking for a new home. While the people running these sites were initially thrilled, their perspective changed last week when police confirmed their involvement and the arrest of the Danishbits operator. Making matters worse, law enforcement didn’t rule out that users could be identified as well. Meanwhile, anti-piracy group Rights Alliance increased the pressure on the remaining trackers. The group informed TorrentFreak that they are aware of the growth of these sites and urged them to give up their illegal activities. If not, they would get the same treatment as DanishBits and NordicBits. This warning wasn’t in vain. Over the past week, the staff of Asgaard considered their options and ultimately decided to throw in the towel. “We are in a situation where our cozy project has suddenly developed into a LARGE Nordic company. With that in mind, it also made us realize that several of the driving forces behind the site have to take a serious look at their involvement with the project,” staff wrote this week.
